One of the biggest gifts you can leave your family is a Will. A well-written Will leaves clear instructions for who should be in charge of tidying up your estate after you pass away, and what should happen with everything you leave behind. You can nominate family members and trusted friends for these roles, and you can include special requests, such as testamentary guardianship for any young children you may leave behind, and your preferences for your funeral service and burial arrangements.

A Valid Will

Having a valid Will can greatly reduce stress for your family, as well as costs. Anyone with a KiwiSaver fund or other asset worth $40,000 or more requires the Court to appoint administrator(s) to be responsible for tidying up your estate. The Court will usually follow your lead on this. However if you do not leave a Will, the law provides a prescriptive basis for who should be appointed in this role, and how your estate is to be distributed among your partner and close family members.

Getting Started?

We recommend an initial discussion with one of our lawyers to identify any legal requirements you need to meet, especially if you have a blended family or other complex family dynamics. You will need to give us the full names of everyone you wish to name in your Will. We are happy to discuss your options with you before you make any decisions.
