Enduring Powers of Attorney (EPAs)

Just like we needed our parents to make decisions on our behalf when we were children, sometimes we need someone to make decisions on our behalf when we get older or if we suffer a significant medical event. With an Enduring Power of Attorney (EPA), you can nominate trusted people to act as your attorney and make decisions on your behalf in the event you lose the ability to make or communicate decisions in the future. In making any decisions on your behalf, your attorneys must work in with you as much as possible to ensure that the decisions made best reflect your wishes and needs.

EPAs are Customised for You

Enduring Powers of Attorney usually come as a set of two, with one EPA for your property and finance matters, and the other EPA for your personal care and welfare decisions. We will talk you through the options you can choose to include in these documents. Because of the significant nature of these documents, you must receive independent legal advice from a lawyer or registered legal executive before you sign an EPA. EPAs must be made while you have mental capacity to do so, otherwise a trusted person will need to make an application to the Family Court for the Judge to appoint a decision-maker on your behalf.

Getting Started?

Please make an appointment with one of our lawyers so we can discuss your situation and any particular requirements you may have. We will need the full names and contact details of your chosen attorneys. Once we have all relevant information, we will prepare the documents for signing at a follow-up appointment.
